Admission of Foreign Lawyers

There are no special exemptions or recognition of qualifications that apply in respect of persons qualified as attorneys in any country in terms of the Attorneys Act, No. 53 of 1979, other than the former TBVC States (Transkei, Bophuthatswana, Venda and Ciskei), Zimbabwe, Swaziland, Lesotho and Namibia.

One should consider the important fact that the admission requirements in these countries are regulated by totally different statutes.

The main requirements for admission as an attorney in South Africa are prescribed by the Attorneys Act, 1979

NOTICE OF SPECIAL MEETING OF MEMBERS: 16 APRIL 2012

Notice is hereby given by the Council to all members in terms of Rule 15 of the Rules of the Law Society of the Northern Provinces (incorporated as the Law Society of the Transvaal) that a special meeting of members will be held on Monday, 16 April 2012 at 14:00 at the CSIR International Convention Centre Meiring Naude Road Brummeria Pretoria for consideration of the following motion of which due notice is hereby given by the Council:

"That in itms of Rule 104.1 of the Rules of the Law Society, read with Sections 60(2) and 69(1)) of the Attorneys Act, 1979, the Council is authorised:
a) to increase the annual subscription payable by a member of the Law Society in respect of the financial year commencing on 1 July 2012 to R2 350 (VAT excluded);
b) to thereafter increase the annual subscription payable by a member of the Society in respect of any financial year commencing on or after 1 July 2013, by an amount equivalent to the average inflation rate (CPI - the average percentage over the preceding twelve months).

Please take note of the content of Rule 3 of the Rules of the Law Society of the Northern Provinces
3.1 Every person who is admitted and enrolled or readmitted and re-enrolled as an attorney of the Court or whose name has been placed or again placed on the Roll of the Court shall within 30 days after the date of his/her admission and enrolment or of his/her readmission and re-enrolment or after the date on which his/her name has been so placed or again placed on the Roll, as the case may be, lodge with the secretary a statement, and with the Registrar a duplicate of that statement.
Members should note that it is unprofessional conduct if a member does not inform the Law Society timeously of any changes of firm and contact details!

Members are reminded that High Court applications for admission, contracts of articles, session agreements and records related notices (e.g. registration of members, opening/closing of practices, Fidelity Fund certificates) can only be served on the Law Society daily between 08:30 and 12:30. The staff in these sections are also only available for visits by and consultations with members during these hours.
